The Following rules and regulations form an integral part of the WYKS Contest Rules. Contestants must qualify to win said contest by following the terms and conditions set forth below. The following rules apply to all contests conducted by KISS 105.3 unless otherwise stipulated.
1. No purchase, sale or registration fee required to participate. Contest open to all persons twelve (12) years of age or older. Employees of Gillen Broadcasting Corp. Inc. (hereafter referred to as ‘KISS 105.3’), any Gainesville/Ocala broadcasting company, contest sponsors, their affiliates, subsidiaries and/or agencies, and their immediate families are ineligible to win said contest.
2. To be entitled to a prize, winners must successfully complete all tasks/challenges required of them by KISS 105.3 staff, and
a. Execute all documents, forms, releases and other instruments authorizing the use of his/her name, voice, photograph (still, motion picture, video or digital) and other basic personal information for promotional purposes by KISS 105.3, contest sponsors, their affiliates, subsidiaries and/or agencies without further remuneration, and;
b. Agree in writing that KISS 105.3, contest sponsors, their affiliates, subsidiaries and/or agencies, and their employees shall be indemnified and held harmless from any and all claims, judgments, decrees or liabilities arising directly or indirectly from participation in the Secret Sound Contest, or any prize awarded therein, and;
c. Claim their prize within thirty (30) days at the KISS 105.3 studios, 7120 SW 24th Avenue, Gainesville, FL. 32607, Monday through Friday between 0830 and 1730 hours, except for legal holidays and other occasions as may be determined by KISS 105.3, and;
d. Agree to such other terms, conditions and requirements as may be reasonably set forth by KISS 105.3.KISS 105.3 reserves the right to alter, amend or cancel any contest at any time for any reason, stated or unstated. KISS 105.3 and contest sponsors also reserve the right to substitute for any prize, another prize of equal or greater value, for any reason, stated or unstated.
3. Only one prize winner per household per thirty (30) days. Households are defined as any residence used as the primary residence for an individual by the Untied States Post Office, and/or any residence inhabited by an individual for more than 15 days during the month contestant enters said contest.
4. Prize winners are responsible for any and all federal, state and/or local taxes, fees, duties, registration costs, gratuities and any and all other charges and or fees incurred in the use of any prize won that is not specifically detailed in the prize description listed above. In the event any single or cumulative prize total in a calendar year exceeds $600.00, KISS 105.3 or contest sponsors will file an IRS Form 1099 with the Internal Revenue Service, and will attempt to send a copy to the contest winner at the address specified on their contest release form.
